Please read these Terms and Conditions carefully before placing an order.
By placing an order through our website, you agree to be bound by these Terms and Conditions. If you do not agree, you must not place an order. If you have any questions, please contact us before ordering.
1. Application
1.1 These Terms and Conditions apply to all purchases of goods made by you (the Customer, you) from us (the Supplier, SuperPro, we, us) through our website superpro-suspension.com (the Website).
1.2 These Terms apply regardless of where you are located. However, your purchase may also be subject to mandatory local consumer protection laws in your country or region. Nothing in these Terms limits or excludes rights you may have under applicable consumer law that cannot be excluded.
1.3 You must be at least 18 years old (or the legal age of majority in your jurisdiction) to place an order.
1.4 If you purchase Goods on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. Interpretation
In these Terms and Conditions:

Consumer means an individual purchasing Goods primarily for personal, domestic or household use.

Contract means the legally binding agreement between you and us for the supply of Goods.

Delivery Location means the address specified in your Order.

Goods means products offered for sale on the Website.

Trade Customer / Business Customer means a customer purchasing for business purposes (including resale, installation services, workshop use, fleet use, or commercial use).

3. Goods
3.1 Product images, specifications and descriptions on the Website are provided for general guidance. Minor variations may occur due to manufacturing changes, improvements, or supply chain updates.
3.2 All Goods are subject to availability. We may withdraw or update Goods at any time.
3.3 In some cases, Goods may be modified to comply with legal, regulatory, or safety requirements.
4. Fitment, Compatibility & Vehicle Information (IMPORTANT)
4.1 It is your responsibility to ensure the Goods are suitable for your intended application.
4.2 Where the Website provides vehicle fitment guidance (including make/model/year/series/variant, engine, drivetrain, trim level, build date, VIN-based fitment, or compatibility tools), this information is provided in good faith but may not account for:

vehicle modifications,

regional specification differences,
-
production changes within a model year,
-
aftermarket components already installed,
-
wear, damage, or prior repairs.
4.3 You must verify compatibility prior to installation. If unsure, contact us before ordering and provide complete vehicle details.
4.4 To the maximum extent permitted by law, we are not liable for losses arising from ordering incorrect Goods due to incomplete or incorrect vehicle information supplied by you.
5. Installation, Safety & Professional Use
5.1 Many suspension components require specialised tools, mechanical knowledge, and safe workshop practices. We recommend professional installation by a qualified mechanic.
5.2 You are responsible for ensuring installation complies with:

the manufacturer’s instructions,
-
relevant roadworthiness laws,
-
safety standards in your jurisdiction.
5.3 Improper installation may cause vehicle damage, unsafe handling, serious injury or death. To the maximum extent permitted by law, we are not responsible for losses caused by incorrect installation or use.
6. Off-Road, Heavy Duty & Motorsport Use
6.1 Some Goods are designed for off-road use or heavy-duty applications. You must ensure the Goods you purchase are appropriate for your use case.
6.2 Unless explicitly stated otherwise, Goods are not designed, tested or certified for motorsport/competition use.
6.3 Use in motorsport/competition, extreme off-road conditions, or outside intended design parameters may void warranties to the extent permitted by law.
7. Personal Information & Privacy
7.1 We collect and handle personal information in accordance with applicable privacy and data protection laws and our Privacy Policy.
7.2 By placing an Order, you consent to our collection, use and disclosure of personal information as described in our Privacy Policy.
8. Basis of Sale / Contract Formation
8.1 Information on the Website is an invitation to treat and does not constitute a binding offer.
8.2 When you place an Order, you are making an offer to purchase the Goods.
8.3 We may accept or reject an Order at our discretion (including due to stock availability, payment verification, suspected fraud, shipping limitations, pricing errors, or compliance requirements).
8.4 A Contract is formed only when we send you an Order Confirmation.
8.5 You are responsible for checking your Order Confirmation and notifying us promptly of any errors.
8.6 Any variations to the Contract must be agreed in writing (including by email) by us.
9. Pricing, Currency, Taxes & Payment
9.1 Prices displayed on the Website are shown in the currency selected (or default currency shown) at the time of purchase.
9.2 Unless stated otherwise:

prices may include or exclude sales tax, VAT/GST, or similar taxes depending on your location, and

shipping charges are shown at checkout (if applicable).
9.3 You are responsible for any applicable local taxes, duties, import charges, brokerage fees or customs charges unless we expressly state that they are included.
9.4 We accept payment via the payment methods shown at checkout (including credit/debit card, PayPal and other providers). Payment must be received in full before Goods are shipped.
9.5 If a pricing error occurs, we may cancel the Order and refund you. If possible, we may contact you to confirm whether you wish to proceed at the corrected price.
10. Delivery
10.1 We aim to dispatch and deliver Goods within the timeframes shown at checkout or in the Order Confirmation, however delivery times are estimates only.
10.2 Delivery may be delayed due to events outside our reasonable control (including carrier delays, customs processing, supply issues, or force majeure events). We will use reasonable efforts to notify you of significant delays.
10.3 If delivery is delayed materially, you may be entitled to cancel the Order and receive a refund in accordance with applicable law.
10.4 We may deliver Goods in instalments. Each instalment is treated as a separate delivery.
10.5 If you fail to accept delivery or provide accurate delivery details, we may charge reasonable additional costs for re-delivery, storage, or return shipping.
11. International Orders & Importation
11.1 We may offer international shipping to certain locations. If your location is not supported at checkout, please contact us.
11.2 For international orders, you acknowledge and agree that:

customs authorities may inspect or delay shipments,

additional documentation may be required, and

you are responsible for complying with import laws and paying any import-related charges.
11.3 If Goods are returned to us due to failed delivery, refusal to pay import charges, or incorrect address details, we may deduct return shipping and handling costs from any refund (where permitted by law).
12. Risk and Title
12.1 Risk in the Goods passes to you on delivery to the Delivery Location.
12.2 Title (ownership) in the Goods passes to you only when we have received full payment (including any applicable delivery fees).
13. Cancellation, Returns & Refunds
13.1 Consumer change of mind
Where you are a Consumer, you may have rights to cancel or return Goods under consumer laws applicable in your region (for example, cooling-off periods in some countries).
Where applicable, cancellation rights generally:

apply only to unused Goods in original packaging, and
-
may not apply to custom-made, special order, clearance, or perishable items.
13.2 Our returns policy
Unless otherwise required by law, our policy is:

you may request cancellation before dispatch, and
-
after delivery you may request a return within 14 days of receiving the Goods.
13.3 Returned Goods must be:

unused, undamaged, and in original packaging, and
-
returned with proof of purchase.
13.4 Return shipping costs are your responsibility unless:
13.5 Refunds will be processed to the original payment method within 14 days of receiving the returned Goods (or earlier where required by law).
13.6 We may refuse a return or reduce a refund if returned Goods are used, damaged, missing parts, or not returned in original condition, to the extent permitted by law.
14. Trade / Business Customer Terms (B2B)
14.1 If you are a Trade Customer / Business Customer:

you acknowledge you are purchasing for business purposes, and
-
certain Consumer protections may not apply.
14.2 To the maximum extent permitted by law for B2B transactions:

change-of-mind returns are not accepted unless approved by us in writing, and
-
any warranty claims may be limited to repair or replacement only (at our option).
14.3 Trade pricing, wholesale arrangements, reseller terms, and workshop supply agreements may be subject to separate written terms.
15. Warranty & Consumer Guarantees
15.1 Our Goods come with guarantees that cannot be excluded under applicable consumer law.
15.2 To the extent permitted by law, our warranty obligations are limited to repair, replacement, or refund (at our option) for Goods that are faulty, not as described, or otherwise fail to meet applicable statutory guarantees.
15.3 Manufacturer warranty details (where applicable) are available on the Website or can be provided upon request.
15.4 Warranty does not cover:
-
normal wear and tear,
-
incorrect installation,
-
misuse, modification, or unauthorised repairs,
-
use in motorsport/competition where not designed for such use,
-
failure caused by other vehicle components,
-
damage due to accidents, corrosion, contaminants, or improper maintenance.
16. Intellectual Property
16.1 All content on the Website, including text, images, graphics, logos, videos, product descriptions, technical content, and downloadable documents, is owned by or licensed to us and protected by intellectual property laws.
16.2 You may not copy, reproduce, distribute, display, modify, publish, or create derivative works from Website content without our prior written consent, except where permitted by law.
16.3 “SuperPro” and related marks are trademarks of their respective owners. Use of trademarks without authorisation is prohibited.
17. Successors, Assignment & Subcontracting
17.1 We may assign or subcontract any of our rights or obligations under the Contract, provided this does not reduce your rights under these Terms.
17.2 You may not assign your rights under the Contract without our prior written consent.
18. Force Majeure
18.1 Neither party is liable for delay or failure to perform obligations caused by events outside reasonable control, including (without limitation) natural disasters, war, strikes, supply chain disruptions, cyber incidents, government actions, pandemics, or carrier interruptions.
18.2 The affected party must notify the other as soon as reasonably practicable.
19. Limitation of Liability
19.1 Nothing in these Terms excludes or limits liability for:
-
fraud or fraudulent misrepresentation,
-
death or personal injury caused by negligence, or
-
any liability that cannot be excluded under applicable law.
19.2 Subject to clause 19.1, and to the maximum extent permitted by law:
-
we are not liable for indirect or consequential losses (including loss of profits, loss of business, loss of opportunity, or reputational loss), and
-
our total liability arising out of or in connection with any Contract is limited to the amount paid by you for the Goods in that Order.
19.3 You acknowledge that Goods are intended for lawful automotive use and must be installed and used appropriately.
20. Complaints & Support
20.1 If you have a complaint or issue, please contact us with your Order details. We aim to respond within a reasonable timeframe, typically within 5 business days.
21. Governing Law & Jurisdiction (Global)
21.1 These Terms and any Contract are governed by the laws applicable in the jurisdiction where the Supplier entity fulfilling your Order is established, unless mandatory consumer laws in your jurisdiction require otherwise.
21.2 Courts of competent jurisdiction will have authority over disputes, subject to any mandatory consumer protection rights you may have in your country or region.
22. Changes to These Terms
22.1 We may update these Terms from time to time. The Terms in force at the time you place your Order apply to that Order.
